1. Applicability and Acceptance

1.1 These Terms of Use apply to the use of the Mandje mobile application and all related online services offered by Mandje (collectively: "Mandje").

1.2 By installing, using, or creating an account for Mandje, you agree to these terms. When creating an account, we will ask you to actively agree; the terms and the Privacy and Cookie Policy can be found in the app and on the website. If you do not agree, you must not use Mandje.

2. What Mandje is (and is not)

2.1 Mandje is a price and promotion aggregator for supermarkets in the Netherlands. Mandje does not sell products, does not fulfill orders, and does not represent supermarkets.

2.2 Information in Mandje is for informational purposes only. Prices, availability, images, and promotions are subject to change and may differ in-store.

2.3 Mandje does not act on behalf of supermarkets and is not an intermediary for purchases.

3. Age and Eligibility

3.1 You must be at least 16 years old to create an account.

3.2 By creating an account, you represent that you meet this requirement and are authorized to enter into an agreement.

4. Accounts and Access

4.1 Certain features are only available with an account (Apple, Google, or email). Mandje's basic features can be accessed without logging in.

4.2 In principle, each natural person is intended to have only one account. You must not create or use accounts in a way that results in abuse, fraud, bypassing restrictions, or disrupting Mandje. Sharing or reselling accounts is not permitted.

4.3 Accounts are not tied to a specific device and can be used across multiple devices.

4.4 You are responsible for keeping your login credentials confidential and for all activities under your account.

4.5 You can delete your account via the app. Upon deletion, your personal data will be erased or anonymized in accordance with the Privacy Policy. Shared lists of which you are the owner will be permanently deleted, including for other members. Your membership in other people's shared lists will be terminated. These actions are irreversible.

4.6 Users can upload a profile picture. By uploading a photo, you declare that you own the rights to the image and that it does not contain offensive, misleading, or unlawful material. Mandje may remove profile pictures that violate these terms, third-party rights, applicable law, or the safety or proper functioning of the service, or if Mandje reasonably suspects this is the case.

5. Loyalty Cards & Wallet Passes

5.1 Users can upload standard loyalty cards (such as supermarket bonus cards) to keep them handy digitally; optionally, an Apple Wallet/Google Wallet pass can be created.

5.2 Mandje stores the card's barcode; additional metadata may be processed (store name, store ID, barcode number, barcode format, and creation date).

5.3 No real-time card data (such as points or rewards) is retrieved.

5.4 The use of Apple Wallet/Google Wallet is subject to their own terms and conditions. Mandje is not responsible for those systems or any service interruptions.

5.5 Mandje does not act on behalf of the supermarket or cardholder involved and does not grant any rights to discounts, points, or access.

5.6 The app may use your device's camera to scan barcodes. Camera images are processed strictly locally and are not stored or transmitted. Use of the camera requires your explicit permission via your operating system.

5A. Shared Shopping Lists

5A.1 Logged-in users can create shopping lists and share them with others via an invitation link.

5A.2 When participating in a shared list, your display name and profile picture will be visible to all other members of that list.

5A.3 List content (products, quantities, and checked-off status) is synchronized in real time among all members.

5A.4 The owner of a list can delete it, which deletes it for all members. Members can leave a shared list independently.

5A.5 Mandje is not responsible for the content added to a shared list by other members.

6. Data Sources and Accuracy

6.1 Price and product information comes from public APIs and automated sources.

6.2 Certain prices/images are collected automatically and may contain errors, delays, or omissions.

6.3 Mandje uses a best-efforts standard for keeping information up to date and accurate; it does not guarantee real-time accuracy.

6.4 You can report inaccuracies using the "Report a Problem" feature; Mandje reviews reports but is not obligated to correct them.

6.5 The price, availability, and terms as they apply in-store or in the official app or cash register of the respective supermarket are always leading. Offers may vary by region or store location, and images are for illustrative purposes only.

6A. Alcohol Products

6A.1 Mandje may display price or promotion information for products classified as alcoholic or age-restricted.

6A.2 Mandje does not sell alcohol, does not advertise in its own name, and does not encourage consumption. The information displayed is strictly informational.

6A.3 Mandje is not responsible for the content or legality of alcohol promotions offered by supermarkets.

6A.4 Users are personally responsible for complying with age limits and local legislation (such as NIX18).

6A.5 If you add an age-restricted product to your favorites and enable notifications, you may receive alerts about that product, such as price changes. These notifications result from your own choice and do not constitute advertising by Mandje.

7. Permitted and Prohibited Use

7.1 You may use Mandje for personal, non-commercial use, in compliance with these terms and applicable law.

7.2 Strictly prohibited activities include:

Scraping, crawling, or automated extraction of data from Mandje
Commercial use, republication, or resale of data without permission
Reverse engineering or attempting to access source code
Bypassing security or technical measures
Use that violates laws, regulations, or third-party rights
Bulk downloads or automated queries that place an unreasonable load on the infrastructure
Using Mandje data for competing or derivative datasets without permission
Manipulating business rankings, links, statistics, or other features
Abusing invitation or sharing links

8. Intellectual Property

8.1 The app, software, database structure, UI/UX, texts, and the Mandje logo are owned by Mandje and protected by intellectual property rights.

8.2 All product and brand names, logos, and images of supermarkets remain the property of their respective owners.

8.3 Product and brand names, logos, and images are displayed solely to identify products, stores, and promotions. Mandje does not claim to be the owner, official partner, or representative of these parties.

9. Privacy and Data Use

9.1 Personal data is processed in accordance with our Privacy & Cookie Policy.

9.2 Mandje may analyze anonymized or aggregated data for statistical or research purposes.

9.3 When you delete your account, your personal data is erased or anonymized.

10. Availability

10.1 Mandje is provided "as is" and "as available." No guarantee is given regarding uninterrupted operation.

10.2 Mandje may be temporarily suspended for maintenance, security, or legal reasons.

10.3 Mandje may modify, add, or discontinue features. In case of changes with substantial consequences for the use of Mandje, we will inform you in advance or as soon as possible, unless this is not reasonably possible due to security, abuse, technical necessity, or legal obligations.

11. Termination

11.1 Mandje may suspend or terminate your access in case of fraud, violation of these terms, or abuse. In the event of (suspected) fraud or a serious violation, this can be done with immediate effect; in other cases, Mandje will notify you first and offer a reasonable period to remedy the violation before proceeding to termination.

11.2 You can stop using Mandje at any time and delete your account via the app.

12. Liability

12.1 Mandje's total liability is limited to €50 per user/incident, to the extent permitted by applicable law.

12.2 Mandje is not liable for: indirect damages, loss of profits, inaccuracies in prices/images, or failures of third-party services (Wallet, app stores).

12.3 These limitations do not apply in cases of intent or deliberate recklessness and do not affect mandatory consumer rights under applicable law.

13. Third-Party Services

13.1 Mandje may contain links to third-party websites or services (including supermarkets and Wallet providers). Mandje accepts no liability for their content or terms.

13.2 Use of third-party services is at your own risk.

14. Changes

14.1 Mandje may update these terms. In the event of material changes, users will be informed via in-app notification.

14.2 Continued use of Mandje after an update constitutes acceptance of the new terms.

15. Applicable Law

15.1 These terms are governed by Dutch law.

15.2 Disputes will be submitted to the competent court in Amsterdam. If you are a consumer, you may also submit a dispute to the court competent by law in your place of residence, and mandatory rules on judicial jurisdiction remain unaffected.

15.3 Before initiating any legal proceedings, Mandje kindly requests that you contact us first at [email protected]. Mandje aims to respond within 14 days.
